Acuerdo Para Servicios Fotográficos

 

1. Definiciones. Cliente: es toda persona natural o jurídica que solicite los servicios de LOLIANA MORATINOS. Fotógrafo: es aquella persona cuya actividad artística u ocupación consiste en tomar fotografías mediante el uso de una cámara u otro dispositivo capaz de almacenar una réplica bidimensional de la realidad y ofrece sus servicios. Proyecto: se entiende como una sesión fotográfica encomendado a LOLIANA MORATINOS. Herramientas: son todos los equipos electrónicos, aplicaciones gráficas, editores, programas de diseño, diseños, papelería, material fotográfico y audiovisual. 2. Desarrollo del proyecto. Este proyecto será desarrollado utilizando las herramientas que LOLIANA MORATINOS considere necesarias para su ejecución. 3. LOLIANA MORATINOS tendrá la exclusividad de tomas fotográfica. 4. Marcas Registradas. El cliente incondicionalmente garantiza que los elementos de texto, gráficos, fotos, diseños y marcas registradas entregadas a LOLIANA MORATINOS para que sean incluidos en este proyecto son de su propiedad o que el cliente tiene permiso por escrito de sus propietarios para hacer uso de estos, quedando LOLIANA MORATINOS libre de cualquier responsabilidad o reclamo por parte de sus propietarios. Todos los proyectos llevarán por escrito los créditos que corresponden a LOLIANA MORATINOS como fotógrafo, productor, diseñador de estos con un enlace a su página web. 5. Derechos de Autor. LOLIANA MORATINOS se reserva todo los Derechos de Autor, reproducción, impresión y publicación de este proyecto. LOLIANA MORATINOS tendrá el derecho de mantener una copia de este proyecto para ser exhibido como muestra de sus servicios y ser incluido en su portafolio, pagina web, redes sociales, propagandas, publicidad, etc.. Se acuerda expresamente en este contrato todos los derechos de uso y derechos de Autor incluidos los derechos sobre negativos y archivos digitales, de imágenes y cualquier otro material producido por LOLIANA MORATINOS y que cualquier reproducción del material se reserva a LOLIANA MORATINOS y su beneficio comercial. 6. Liberación de Derechos Fotográficos. Yo (Nombre del Cliente) _________________________________________________________________________, sedo todos los derechos, más los derechos de Autor, imagen, nombre, reproducción, impresión, propagandas y publicación, etc. de este proyecto a LOLIANA MORATINOS. 7. Acuerdo de Pago y Responsabilidades. El costo total del proyecto según el paquete seleccionado por el cliente es de $___________. El cliente se compromete a pagar al momento de la firma de este contrato el monto de $__________. Posteriormente el día del evento debe estar ya completamente pagado el monto total de este proyecto para poder ejecutarlo. LOLIANA MORATINOS se reserva el derecho de no asistir a este evento o no realizar este proyecto en caso de no haber recibido el pago completo, total por los servicios solicitados para este proyecto. En caso de que llegue el día estipulado para realizar el proyecto y el cliente no haya pagado el costo total de este proyecto, LOLIANA MORATINOS dará por terminado este acuerdo y el dinero pagado a LOLIANA MORATINOS será tomado como gastos incurridos del fotógrafo sin derecho a reembolso (No hay devolución de dinero). 8. Cancelación y Reembolso. El Cliente podrá realizar la cancelación de este contrato, por cualquiera que sea el motivo. Sin embargo El Cliente entiende que debe notificar esta cancelación con un mínimo de 20 días de anticipación a la fecha de realización de este proyecto y el reembolso será solo del 20% del dinero entregado a LOLIANA MORATINOS. Si El Cliente realizar una cancelación con menos de 20 días de anticipación a la fecha de realización de este proyecto, no existe la posibilidad de reembolso de dinero (no hay devolución de dinero). En caso de la no presencia del cliente o cualquier complicación, contratiempo, atraso, el posponer o la cancelación del evento o proyecto el día de ejecución del mismo, no hay devolución del monto total de dinero pagado por el cliente. En el supuesto de un caso de fuerza mayor por el cual el fotógrafo se vea en la imposibilidad de realizar la cobertura del evento o proyecto, el fotógrafo realizara el mejor esfuerzo para asegurar la cobertura del evento por medio del uso de los servicios de otro fotógrafo. Sin embargo la responsabilidad legal del fotógrafo bajo cualquier circunstancia se limita a la devolución total del dinero recibido del cliente. 9. Entrega. LOLIANA MORATINOS se compromete a hacer entrega del proyecto (paquete fotográfico) en un plazo de 45 días hábiles después del día del evento y después de que el cliente haya hecho entrega de todo el material necesario para su ejecución. En caso de que el cliente no haya entregado el material en el transcurso de los 45 días habiles posteriores al evento, LOLIANA MORATINOS no se hace responsable por las demoras, ni retrasos que tenga la entrega del proyecto, ni tampoco danos o gastos que esto traiga al cliente, ni a terceros. Contract for Photographic Service

 

1. Definitions Client: is any natural or legal person that requests the services of LOLIANA MORATINOS. Photographer: is a person whose artistic activity or occupation consists of taking photographs through the use of a camera or other device capable of storing a two-dimensional replica of reality and offering its services. Project: it is understood as a photographic session entrusted to LOLIANA MORATINOS. Tools: are all electronic equipment, graphic applications, editors, design programs, designs, stationery, photographic and audiovisual material. 2. Project development. This project will be developed using the tools that LOLIANA MORATINOS considers necessary for its execution. 3. LOLIANA MORATINOS will have the exclusivity of photographic shots. 4. Trademarks. The customer unconditionally guarantees that the elements of text, graphics, photos, designs and trademarks delivered to LOLIANA MORATINOS to be included in this project are their property or that the client has written permission from their owners to make use of them, being LOLIANA MORATINOS free of any responsibility or claim by its owners. All the projects will have in writing the credits that correspond to LOLIANA MORATINOS as photographer, producer, designer of these with a link to their website. 5. Copyright. LOLIANA MORATINOS reserves all the Copyrights, reproduction, printing and publication of this project. LOLIANA MORATINOS will have the right to keep a copy of this project to be displayed as a sample of its services and be included in its portfolio, website, social networks, advertisements, advertising, etc. This contract is expressly agreed to all rights of Use and copyrights including rights over negatives and digital files, images and any other material produced by LOLIANA MORATINOS and that any reproduction of the material is reserved to LOLIANA MORATINOS and its commercial benefit. 6. If the Client make a cancellation less than 20 days before the date of realization of this project, there is no possibility of refunding money (there is no refund of money). In case of no customer presence or any complication, mishap, delay, postpone or cancellation of the event or project on the day of execution, there is no refund of the total amount of money paid by the customer. In the event of a case of force majeure for which the photographer is unable to cover the event or project, the photographer will make the best effort to ensure coverage of the event through the use of the services of another photographer . However, the legal responsibility of the photographer under any circumstance is limited to the total refund of the money received from the client. 9. Delivery. LOLIANA MORATINOS is committed to delivering the project (photo package) within 45 business days after the day of the event and after the client has delivered all the necessary material for its execution. In case the client has not delivered the material during the 45 working days after the event, LOLIANA MORATINOS is not responsible for delays, or delays that have the delivery of the project, nor damages or expenses that this brings to the client, or to third parties. Loliana Moratinos will not be responsible for any demands or damages caused by any other. Refund Policy: Full refund of money will only be possible if a change is made or if the agreement is canceled at least two days before the photo shoot date specified in this document. In case you want to make a change or cancellation to this agreement, the day before the photo shoot (date stipulated in this document), the day of the photo shoot, in the photo session or after being taking the photo shoot, there is NO possibility of any reimbursement or refund. The customer unconditionally guarantees that all elements of text, graphics, photos, designs and trademarks delivered to LOLIANA MORATINOS to be included in this project are their property or that the client has written permission from their owners to make use of these , leaving LOLIANA MORATINOS free of any responsibility or claim by its owners.
All the projects will have in writing the credits corresponding to LOLIANA MORATINOS as designers of these with a link to their website. LOLIANA MORATINOS will have the right to keep a copy of this project to be displayed as a sample of its services and be included in its portfolio, website, social networks, advertisements, advertising, etc.
4. Maintenance The maintenance offered with each web page design package consists of making minor modifications during the period mentioned in each one of these. Maintenance is calculated based on half hour of work per month at $ 45 per half hour. (This amount may vary annually). 7. Payment. The client commits to pay 60% of the cost according to the selected package at the signing of this contract. After the delivery of the project, the remaining 40% will be paid on the cost of the package plus the additional charges for other contracted services. LOLIANA MORATINOS reserves the right to remove from the Internet or not publish the website until it has received full payment for the services provided.

Proyecto: se entiende como el trabajo de diseño del página web encomendado a LOLIANA MORATINOS.

Herramientas: son todas las aplicaciones gráficas y editores de texto.

2. Desarrollo del proyecto. Este proyecto será desarrollado utilizando las herramientas que LOLIANA MORATINOS considere necesarias para su ejecución.

3. Derechos de autor y marcas registradas. El cliente incondicionalmente garantiza que todos los elementos de texto, gráficos, fotos, diseños y marcas registradas entregados a LOLIANA MORATINOS para que sean incluidos en este proyecto son de su propiedad o que el cliente tiene permiso por escrito de sus propietarios para hacer uso de estos, quedando LOLIANA MORATINOS  libre de cualquier responsabilidad o reclamo por parte de sus propietarios.

Todos los proyectos llevarán por escrito los créditos que corresponden a LOLIANA MORATINOS  como diseñadores de estos con un enlace a su página web. LOLIANA MORATINOS  tendrá el derecho de mantener una copia de este proyecto para ser exhibido como muestra de sus servicios y ser incluido en su portafolio, pagina web, redes sociales, propagandas, publicidad, etc.

4. Mantenimiento. El mantenimiento que se ofrece con cada paquete de diseño de página web consiste en realizar modificaciones menores durante el período mencionado en cada uno de estos. El mantenimiento se calcula sobre la base de media hora de trabajo por mes a $45 cada media hora. (Este monto puede variar anualmente). Las modificaciones están limitadas a pequeños cambios en oraciones o párrafos de texto, a sustituir fotografías por otras del mismo formato o actualizar enlaces. No incluye reemplazar todo el texto en una página, páginas nuevas, cambios en el sistema de navegación, cambios en la estructura de las páginas, corregir intentos de otros en hacer modificaciones a las páginas. El periodo de mantenimiento comenzará a partir de la fecha de entrega del proyecto y se cobrara solo en caso de ser necesario estos servicios.

5. Entrega. El cliente y LOLIANA MORATINOS deben trabajar conjuntamente para terminar el proyecto puntualmente. Nosotros nos comprometemos a hacer entrega del proyecto en un plazo de _____________________, después de que el cliente haya hecho entrega de todo el material necesario para su ejecución. En caso de que el cliente no haya entregado el material en los _________________________siguientes a la firma de este contrato, LOLIANA MORATINOS dará por terminado este y el dinero pagado a LOLIANA MORATINOS será tomado como honorarios de pago por el tiempo trabajado sin derecho a reembolso (No hay devolución de dinero).

La publicación de este proyecto se realizara en un servidor de Internet propuesto por LOLIANA MORATINOS, mediante el pago del monto total del paquete y servicios adicionales solicitados por el cliente.

6. Publicación. El cliente entiende que LOLIANA MORATINOS no ofrece el servicio de hospedaje de páginas web. Este servicio implica la elaboración de un contrato aparte con el proveedor del servicio de hospedaje en Internet. El cliente está de acuerdo en seleccionar un proveedor de hospedaje en Internet propuesto por LOLIANA MORATINOS para la publicación del proyecto. Todos los cargos del servicio de hospedaje son por cuenta del cliente.

7. Pago. El cliente se compromete a pagar al momento de la firma de este contrato el 60% del costo según el paquete seleccionado. Posteriormente al momento de la entrega del proyecto pagara  el 40% restante sobre el costo del paquete más los cargos adicionales por otros servicios contratados. LOLIANA MORATINOS se reserva el derecho de quitar de Internet o no publicar la página web hasta haber recibido el pago completo por los servicios prestados.
